Welcome to Eye Popping Promotions. These Terms & Conditions govern your use of our website and your purchase of
products and services from Eye Popping Promotions. By using our website, requesting or approving an order, making a
payment, or otherwise purchasing products or services from us, you agree to these Terms & Conditions.
1. Products and Services
Eye Popping Promotions provides promotional products, customized merchandise, branded products, printing, and
related promotional services. Product colors, sizes, materials, appearance, packaging, and other characteristics may
vary slightly from photographs, digital mockups, proofs, or samples. Product availability and pricing are subject to
change.
2. Quotes and Pricing
Quotes are based on the specifications, quantities, artwork, shipping requirements, and other information available
when the quote is prepared. Prices may change if quantities, product specifications, artwork requirements, shipping
costs, taxes, supplier costs, or other order details change. Applicable taxes, shipping charges, setup charges, artwork
charges, rush charges, and other fees may be added to the order when applicable.
3. Custom Orders and Artwork Approval
Many products sold by Eye Popping Promotions are customized specifically for the customer. Customers are
responsible for carefully reviewing and approving all artwork, spelling, names, telephone numbers, website addresses,
logos, colors, quantities, product selections, and other information before production. Once a customer approves a
proof or artwork and production begins, Eye Popping Promotions is not responsible for errors contained in the
approved artwork. Changes requested after approval may result in additional charges and production delays.
4. Customer-Supplied Artwork and Intellectual Property
By providing Eye Popping Promotions with a logo, photograph, trademark, design, slogan, artwork, or other material,
you represent that you own the material or have permission to use and reproduce it. You authorize Eye Popping
Promotions and its suppliers to reproduce the material as necessary to complete your order. The customer is
responsible for claims arising from materials supplied by the customer that infringe upon another person's copyright,
trademark, or other intellectual-property rights.
5. Payment
Payment may be collected through our website or through a third-party payment processor. Unless otherwise agreed in
writing, payment may be required before an order enters production. By providing payment information, you represent
that you are authorized to use the payment method provided and authorize the applicable charges for your order.
6. Cancellations, Returns and Refunds
Because many of our products are customized or personalized, custom products generally cannot be returned,
exchanged, or refunded after production has begun, except when the merchandise is defective, materially different
from the approved order, or otherwise required by applicable law. Cancellation requests must be made as soon as
possible. If an order is cancelled before production begins, the customer may still be responsible for artwork, setup,
processing, supplier, or other costs already incurred. Orders that have entered production may not be cancellable. Any
claim involving defective, damaged, or incorrect merchandise should be reported to Eye Popping Promotions promptly
after delivery so that we can review the issue and work toward an appropriate resolution.
7. Production and Delivery Times
Production and delivery dates are estimates unless Eye Popping Promotions expressly agrees otherwise in writing. We
will make reasonable efforts to meet estimated delivery dates, but we cannot guarantee delivery dates when delays
result from suppliers, manufacturers, shipping carriers, weather, product shortages, customs, incorrect customer
information, artwork delays, or circumstances outside our reasonable control. Eye Popping Promotions is not
responsible for consequential losses resulting from shipping or production delays beyond our reasonable control.
8. Shipping
Customers are responsible for providing an accurate shipping address. Shipping and delivery charges may be added to
the order. Risk associated with carrier delays or other transportation issues may be subject to the policies of the
applicable shipping carrier and supplier. Customers should inspect merchandise promptly after delivery and contact
Eye Popping Promotions if there is a problem with an order.
9. SMS/Text Messaging Terms
By providing your mobile number and expressly consenting to receive text messages from Eye Popping Promotions,
you agree that we may send SMS or MMS messages consistent with the consent you provided, including messages
concerning quotes, orders, customer service, products, promotions, and special offers.
Message frequency may vary. Message and data rates may apply.
You may opt out of marketing text messages at any time by replying STOP.

Consent to receive marketing text messages is not a condition of purchasing goods or services.

By providing your email address, you agree that we may use it for order-related and customer-service communications.

from promotional emails using the unsubscribe instructions included in those communications.
11. Website Use
You agree not to misuse our website, interfere with its operation, attempt unauthorized access, use the website for
unlawful purposes, or reproduce website content without authorization. Website content, including text, graphics, logos,
and designs owned by Eye Popping Promotions, may not be copied or commercially used without permission.

communications, website hosting, and order fulfillment. The use of third-party services may also be subject to the
applicable provider's terms and privacy practices.
13. Disclaimer and Limitation of Liability

& Conditions is intended to exclude or limit rights or remedies that cannot legally be excluded or limited.
